QLD Laws for Motor Vehicle Accident Claims

In Queensland, when you are the injured person in a road accident and not at fault, you have the right to claim compensation under the Motor Accident Compensation Act of 1994. Regardless of whether you have a whiplash injury, bruising, broken bones, a head, neck or back injury, or are suffering a psychological injury.

QLD personal injury laws give you the right to make a motor vehicle accident compensation claim within three years of the accident date when you know the other driver’s details. A much shorter time frame applies when the other motorists’ details are unknown.

Time Limits for Car Accident Claims

Queensland has strict time limits for making a car accident compensation claim after a traffic accident.

Below are the general deadlines, but be aware that the time limit for your case may differ. When you know the details of the other driver, you must lodge a notice of accident claim form within:

  1. One month from the date you first spoke with a lawyer about making a claim
  2. Or nine months after the date of the accident, whichever comes first.

If the other motorist is unknown or uninsured, you must lodge a claim form with the QLD nominal defendant within nine months.

Failing to lodge a car accident claim or the Notice of Accident Claim Form within the legislated time generally means you can’t seek compensation through a CTP claim. There are some rare exceptions.

Our Gold Coast can advise you of the time limits for your accident during a free case review. Call 1800 700 125

What is the accident claim process?

The circumstances of a road accident will determine the complexity of the accident claim process, e.g.

  • How many parties were involved in the accident?
  • Do the other drivers deny that they were at fault?
  • Is there an unknown driver, for example, in a hit-and-run accident

An accurate claim form would include the following:

  • Police reports
  • Witness statements
  • Medical records
  • Documentation of the scene
  • Proof of financial loss due to injury

A motor vehicle accident lawyer understands the process of informal settlement negotiations with the CTP insurer, which enables the resolution of a compensation claim without court proceedings.

Lodging an insurance claim involves the following steps:

  1. Contact the insurer with photos, video, witness statements, a comprehensive description of the damages, and the other driver’s information.
  2. The insurer investigates the incident.
  3. They assess the extent of the damages.
  4. You could access a rental car based on the policy coverage while processing the claim.

When you collide with an unknown or uninsured driver, the car accident compensation claim process differs. You do not lodge a personal injury claim against a third-party insurance company in this case.

Instead, you lodge a case with the Queensland nominal defendant. This statutory body replaces the third-party insurer, providing fair compensation for a loss. An experienced car accident lawyer understands this process.

NOTE: Nominal defendant claims have short and strict time limits for lodging a personal injury claim.

Gold Coast Motor Vehicle Accident Claim FAQs

The severity of the injury, medical expenses, lost income, and pain and suffering are just a few of the variables that determine the average payout for personal injury claims in Australia.

The at-fault party in a car accident in Queensland is the one who caused the accident due to their negligence by not taking reasonable care while driving. Sometimes, the type of collision and location of vehicle damage also help determine fault.

Learn who is at fault in a car crash >

When a car accident occurs, the person who caused the accident is liable for the damage. If you were at fault, your insurer would cover the damage once your claim is approved. If the other driver is to blame, their third-party insurance company should provide the settlement.

If you are unsure who the at-fault driver was, expert personal injury lawyers know how to determine who was to blame.

If you’re not at fault in a car accident, you can seek damages from their third-party car insurance by collecting the other driver’s details and claiming against their insurance cover.

For car accident claims, a “no win no fee” arrangement means that clients pay no up-front legal fees or costs, and their lawyers are paid from settlement proceeds.

Statistically, most Queensland car accident-related personal injury compensation claims are handled through mediation, avoiding costly court litigation. Court proceedings can be:

  • Unpredictable and expensive
  • Significantly reduce a settlement payout
  • Quite costly if you lose.

Experienced personal injury lawyers can provide advice regarding legal options, including court action.
