Bauer vs Clay
The claimant was driving his Subaru on Princess St, Bundaberg, when he was hit by a stolen car during a police chase. The at-fault vehicle was travelling at 100km/h in a 60km/h zone and collided with the passenger-side door of the other car, forcing it into the gutter and then into a fence. The high-velocity and high-energy impact at the corner of Bunya St caused serious injuries.
The claimant delayed seeking medical treatment despite suffering neck and upper back pain, headaches and shoulder symptoms. He declined an ambulance at the accident scene and did not seek further medical treatment for ten months.
