Motorcycle Accident Cnr Sturt and Newell Streets

Holden v Holzhauser & Fortis Insurance Limited

The claimant, Peter John Holden (a fitter and turner by trade), was injured while riding his motorcycle east along Mulgrave Road, intending to turn right into Newell Street to reach his workplace. The defendant’s vehicle suddenly turned right at the junction of Newell and Sturt Streets, without indicating, resulting in a collision.

Both parties were negligent, with liability assessed at 80% to the claimant and 20% to the defendant.

The injuries were significant and long-lasting and are detailed as follows:

  1. Fracture of the upper surface of the body leading to long-term back pain and disability.
  2. Degenerative changes in the spine with surgery.
  3. Psychological injury: diagnosed adjustment disorder
  • Total assessed damages: $587,301.55
  • Claimant was 80% negligent, so received 20% of the settlement: $117,460.31

Perkins v Woolworths Pty Ltd

The claimant worked on the loading dock at Woolworths, unloading pallets from delivery trucks using a powered walkie stacker. The original machine broke down and Woolworths hired a replacement walkie stacker that did not have either a side-shift or extender reach function.

Staff had to create a new system of unloading that the claimant described as awkward requiring him to stretch, twist and push with great force.

  • Woolworths provided no instruction or training about this new system of work.
  • Management knew the hired machine lacked the necessary functions, yet workers were expected to continue unloading trucks using this improvised method.

The judge found Perkins had suffered both:

  • A serious lumbar spine injury, and
  • A psychiatric injury in the form of an adjustment disorder with depressed mood.

The plaintiff succeeded in his claim and was awarded $650,645.38 in damages, including compensation for:

  • General damages
  • Past and future economic loss
  • Superannuation loss
  • Future medical expenses; and
  • Special damages

Habermann v Cook Shire Council

The claimant succeeded in a negligence claim against the Cook Shire Council. The case is significant because it confirms that an employer’s duty of care extends to taking reasonable steps to protect an employee from foreseeable psychiatric harm caused by third-party dissemination of false material, where the employer had the practical ability to stop or reduce that risk.

  • The claimant worked for Cook Shire Council. During a dispute involving Cayman Cruises, a false email was created in her name suggesting she was racist and had misused her position to prevent an Aboriginal corporation, Gungarde, from obtaining a lease.
  • The Court found the email was plainly fabricated and that the Council had multiple opportunities to demonstrate this to the relevant people
  • The Court also found that the employer owed Mrs Habermann a duty of care to take reasonable steps to protect her from a foreseeable risk of psychiatric injury.
  1. WPI 17%, ISV 25
  2. General damages from ISV: $49,650.00
  3. Total judgement: $2,359,037.64
